TERMS AND CONDITIONS FOR SUBSCRIPTION TO AND USE OF RSK TECH PRODUCTS

These are the Terms and Conditions of RSK Tech Limited, Reg.-No. SC257610 with registered offices at 6 Panmure Street, Dundee, United Kingdom, DD1 2BW . As a subscriber of any RSK Tech product or service you agree to accept the following terms and conditions:

Subscription

Subscription means the purchase of the limited right to use a specified piece of RSK Tech software in a limited period of time, i.e. the subscription period. The limitation of the right is stipulated in the license. RSK Tech subscriptions include software product upgrades, service packs, and hot fixes. By subscribing you agree to automatically request and receive updates from RSK Tech.

Access To Hosted Software

In cases where the software and / or data is hosted by RSK Tech the company will make that software and / or data available for access via internet broadband connection excluding periods of system maintenance where such maintenance is reasonably necessary. RSK Tech will where possible notify system maintenance to the subscriber in advance and will where possible carry out such maintenance outside regular business hours. RSK Tech shall not be responsible for any access failure caused by the acts or omissions of third parties, telecommunications failures or force majeure.

Data And Backup

RSK Tech backup all data subscribers store on RSK Tech servers. Subscribers agree that RSK Tech has the right to delete all data, files, or other information that is stored on RSK Techs servers after 1 month of subscription termination. See Cancellation and Termination for conditions.

Fees

Typically, a 12 month subscription period is agreed. The subscription fee shall be paid upfront for each 3 month period at a time before that 3 month period begins.

Payment

Payment can be made by cheque, by bank transfer,or by credit card. RSK Tech reserves the right to suspend subscribers’ access to the subscription when payments have not been made at the beginning of the new 3 month subscription period or RSK Tech decides that the account has been inappropriately used.

Cancellation And Termination Of Subscription

The subscriber can cancel the subscription by notifying RSK Tech a minimum of 1 week before the end of the current subscription period unless otherwise agreed, e.g. a fixed period has been stipulated by contract. RSK Tech reserves the right to suspend subscribers’ access to the subscription when payments have not been made at the beginning of the new 3 month subscription period or RSK Tech decides that the account has been inappropriately used.

Consequences Of Termination, Cancellation Or Expiry

In the event of expiry, cancellation, or termination of the subscription RSK Tech will reserve the right to suspend subscribers’ access to the subscription. RSK Tech will keep the uploaded contents for the period of one month. In that period subscribers can request those contents on DVD (see price list).

Data Protection

RSK Tech and the subscriber each acknowledge and shall be responsible for ensuring their own full compliance with the Data Protection Acts 1984 and 1998 and all similar laws relating to the protection of personal data in force from time to throughout the world.

Confidentiality

RSK Tech and the subscriber agree to keep confidential business and product-related information the parties may obtain or receive save trivial or obvious information, or information in the public domain other than as a result of a breach of confidentiality. The provision of confidentiality shall survive termination or expiry of the contractual agreement.

Copyright, Intellectual Property

RSK Tech has full ownership of its products, title and interest in and to RSK Tech’s products and services, including without limitation all intellectual property rights. This includes but is not limited to all copyrights, trade and service marks, design rights, patent rights, trade secrets, rights in or relating to databases, rights in or relating to confidential information and any other intellectual property rights throughout the world, whether registered or unregistered and including applications for any such rights. For whatever access or use you may have of RSK Tech’s products and services you may not attempt to or allow third-party attempt to reverse engineer, alter, obscure or remove the product or service. You may not attempt to or allow third-party to attempt to alter, obscure, or remove RSK Tech’s or any third party's copyright notice, trade marks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through RSK Tech products

Third Party Acknowledgements

Windows, Windows NT, Windows XP, Windows 2003, and MS Outlook are the property of Microsoft Corporation. Adobe Illustrator is the property of Adobe Systems Incorporated. Corel Draw is the property of Corel Corporation

Feedback Or Suggestions Provided By Customers

By submitting any feedback or suggestions to RSK Tech you grant RSK Tech and third parties permission to use and incorporate your ideas or comments into its products (or third party software or content) without further compensation.RSK Tech is under no obligation to use any materials you may provide.

Links To Other Websites

The RSK Tech website may provide links to third-party websites for your convenience and information. When you access a third-party website via a link on the RSK Tech website, please understand that you will leave the RSK Tech website and that RSK Tech has no control over the content on that website and does not endorse or accept any responsibility for the contents of any third-party sites, any links contained in third-party sites, any changes or updates to third-party sites, or their privacy practices, which may differ from those of RSK Tech.

Modification Of These Terms And Cconditions

To reflect changes in the service, changes in the laws affecting the services, or for other good reasons, RSK Tech reserves the right to change or update the terms and conditions from time to time. In this case, due notice will be provided. Continued access to or use of the services provided by RSK Tech after any such change shall constitute your consent to such change. Unless explicitly stated otherwise, any new features that change or improve the RSK Tech Services shall be subject to the Terms & Conditions, as modified from time to time.

RSK Tech makes no warranties of any kind, expressed or implied for products or services provided .RSK Tech will not be liable for any consequential, incidental or direct damages suffered in the course of using RSK Tech software.
